Terms and Conditions of usage for the Clients

Definitions

1hmy” – Name of the digital booking system for the beauty and wellness treatments.

1hME” – Unique code associate to each User.

1hPIGGY” – Electronic wallet for optional use set in personal profile of the Users.

Affiliate” – Either Salon, Professional or Private Citizen who has stipulated an agreement with Headquarter about the bookong of beauty or wellness treatments.

APP” – software application for mobile environment and related services provided by Headquarter.

Client” – Registered User who can book treatment by 1hmy service.

Dimensions” – name of the cathegories in which the affiliates are divided.

Headquarter” – synonym of The Alma Development LLC.

Servizio” – it means the entire 1hmy service, mainly the service of booking for beauty or wellness treatments by the Website and the App.

Website” – set of web pages reachable by the address www.1hmy.net and other related addresses.

User” – Every individual who create a personal profile in the 1hmy environment through the App or the Website. A User can be a Client or an Affiliate or both.

Service

1hmy is a booking service for providing either beauty or wellness treatments. The servis, as previously told, is provided by The Alma Development LLC (Headquarter). A Client can search a treatment among the several offered by the Affiliates using both the 1hmy Website and the 1hmy App.
Every detail will be provided in the following paragraphs.

Clients

Every person is able to become a Client of the 1hmy service simply creating a personal profile through the official App available for download both in the Apple Store and in the Google Play Store or filling the form in the Website.
With the creation of a profile, each user accepts the Terms and the Conditions of the service written in this text.

Together with the creation of the profile, the system associate a unique code to the user: the 1hME code. This code will be necessary for the fidelity program 1hWOM.

The process of booking consists of the following steps:

(1) The Client chooses the options for the available filters (e.g. geographical area of search, treatment, category type, brand). Filters are either mandatory or optional.

(2) The search engine find the results compatible with the search criteria. Results are shown in order of distance from the geographical area. The answer is compliant with the duration of the requested treatment inorder to avoid overlaps of sequential appointments.

(3) The Client selects a result and accesses the info-card of the Affiliate to verify his/her characteristics.

(4) The Client pay the treatment.

(5) The Client receives an email message with the terms and the voucher about the appointment.

(6) The Affiliate is able to contact the Client to arrange a different time for the appointment.

(7) The Client uses the code received by email to enjoy the treatment.

The booking service provided by 1hmy is frre of charge for the clients.

Pricelists

The Client pays the purchased treatments with the prices written in a unique pricelist, equal for every Affiliates with the same “Dimension”. The official prices, are available in the App. Prices can be modified by Headquarter in every moment without any forewarning.

It is a Client responsibility to see the price applied at the moment of the booking (by the App or the Website). In case of change of price, a treatment will have the price paid at the booking time.

Payments

The Client pays in advance to 1hmy the price of the treatment booked by the App or the Website. Clients agree to pay the costs of the services and authorize Headquarter to debit their account the relative amount. The Client is responsible for the timely payment of all costs involved, and shall provide to Headquarters a number of credit card or a valid PayPal account.
In the Client personal profile there is an electrnic wallet called 1hPIGGY in which itis possible to deposit temporarily some credit from Client’s PayPal account. The credit can be used only to purchase services or products in the 1hmy system and it is not refundable. The credit can be used only in the Client’s country, that is where it is used the currency of the 1hPIGGY deposit.
Therefore, a customer can pay via PayPal (using its PayPal credit or a credit card accepted by PayPal) or by the credit in his 1hPYGGY.
1hmy do not reimburse payments except in cases where has been proved a booking service interruption. Inconvenience to the service delivery of the treatments are considered in charge only to the Affiliate that caused them.

1hmy uses a system of processing payments provided by a third part (“Payment Processor”) that connects the customer’s credit card by the App and the Web Site. The processing of payments or credits, where applicable, will be subject to the terms, conditions and privacy policy of Payment Processor, and of the company that provide the credit cards, in addition to these Terms and Conditions. Headquarters will not be liable for any error attributable to the Payment Processor.

In reference to the use of the Services by the Clients, Headquarters will have access to some details of the transactions that will be used only in accordance with the Privacy Policy.

Vouchers

The voucher code purchased by the customer for a reservation or for a gift certificate is a title for the amount of the treatment. The voucher, unless otherwise indicated, will expire after 365 days from the date of issue.
The voucher issued by 1hmy can only be used in the country where they were purchased.
Presenting the voucher to the Affiliate, the Client decale “de facto” to have benefited the treatment. When the Affiliate insert the Reservation Code of the Voucher in the system 1hmy, he/she declare, “de facto”, that it has done its job.

Since fulfillment of the Reservation Code, any further discussion about the voucher or the reservation time must be resolved between the Client and the Affiliate except it is shown an irregularity in the 1hmy booking service.

After the expiration date, the Voucher value is not returned. The Voucher 1hmy is not refundable under any circumstances.

Gift Vouchers

When booking, the Client may decide to transform the treatment in a Gift Voucher, that is a code that represents a title of the amount spent by the Client. The beneficiary receives an email with the Gift Voucher and he/her can use it directly by one of the Affiliates without having to create their own profile in the system.

The Gift Voucher, unless otherwise indicated, will expire after 365 days from the date of issue. After the expiration date, the Gift Voucher value is not returned. The Gift Voucher 1hmy is not refundable under any circumstances.

1hWOM Program

Each Client has a chance to get a gift for each new Client and for each new Affiliate that enters the 1hmy network following his/her suggestion. The program is called One Hour Word of Mouth (abbreviated in the acronym 1hWOM). Listed below are the rules to get the gift:

(1) The new User should not have been registered in the 1hmy systems.

(2) The new User must enter in the appropriate field of the registration form the 1hME code of the User who suggested the registration. It’t no possible to get any benefit if the 1hME code were communicated at different times from registration.

The Discount or Bonus Voucher, are awarded in the form of a free gift as a thanks for the User cooperation. The value of the discount or bonus voucher, are defined by the 1hWOM program valid at the time of the new User registration.

1hmy may change at any time awards or conditions, without notice. It is the responsibility of each User to refer to this section and to the information available on the official Website to stay updated on the 1hWOM program.

Different conditions of collaborations can be managed directly with Headquarters outside the Terms and Conditions.

The Discount or Bonus Voucher, unless otherwise indicated, expires after 365 days from the date of issue. The 1hmy Discount or Bonus Voucher is not refundable under any circumstances.

Limitation of liability

The information, recommendations and/or services provided to the User by or through the Website and the App are intended for information purposes only without any commercial intent, with the exclusion of the banner in some pages of the App. Headquarter will use their resources to keep up to date and correct the Website, the App and its contents but does not guarantee that (the contents of) these are free of errors, defects, viruses or malware and that the Website and the APP are accurate, current and precise.

Headquarters will not be considered liable for any damage arising from the use (or inability to use) of the Website or of the App, including damage caused by malware, viruses or other inaccuracy/incomplete information, of the Website or of the APP, unless such damage is clearly derived from willful misconduct or gross negligence in charge at headquarters.

Moreover, Headquarters will not be held responsible for damages arising from the use (or inability to use) of the electronic media in conjunction with the Website or with the APP, which – including – damage resulting from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications made by third parties or by programs used for electronic communications and transmission of viruses.

Notwithstanding the foregoing, and as permitted by applicable law, the entire liability of Headquarter will not exceed, in any way, the amount of USD 500 (five hundred), or where applicable, the equivalent to that amount in the currency used by the User for payment of beauty or wellness services provided by 1hmy network Affiliates.

The quality of health and beauty treatments enjoyed using the services of 1hmy is intended entirely in charge of the Affiliates as providers of end-user services. In any case Headquarter will take responsibility related to and/or arising from services provided and/or produced by the Affiliates or any acts, actions, behavior, conduct and/or serious misconduct attributable to Affiliates. Any complaints relating to services provided by Affiliates will then be notified directly and exclusively to Affiliates themselves.

Regarding the content, 1hmy is a showcase of information and opinions provided by Clients and Affiliates. Headquarters can’t be held in any way responsible for such content. 1hmy is a network created only for the services of health and beauty. Any other use, especially those related to sexual content or services, will not be tolerated. 1hmy is a worldwide network and it’s not designed for the use in a single simultaneous nation: each contextualization of procedures in compliance with local laws is the responsibility of each User who has to apply a personal moderation in the system use.

Headquarter provide the following services:

(a) Build and maintenance of the technical architecture for the Website and for the App.

(b) Marketing actions at national level.

(c) Booking service made by the Website and the App.

(d) Renting of the advertising spaces on the App.

Applicable law

These terms of use are subject to the laws of the Island of Nevis. Any dispute, claim or litigation arising from or related to these Terms and Conditions, or the breach, termination, enforcement, interpretation or validity of them, or the use of the Website, the Service or the App (collectively, “Disputes”) shall be addressed exclusively to the court of jurisdiction of the island of Nevis. Headquarters will only respond to the services provided by 1hmy.

Any dispute relating to the services provided and/or products sold by Affiliates, will be addressed directly and exclusively to Affiliates themselves. The service 1hmy is provided only in the countries published on the Website.

1hmy Account

You must be “major” (“adult” compared to the country of use) in order to use the Service or the App 1hmy. If you reside in a jurisdiction which restricts the use of the Service, the Website or the App or the ability to sign this kind of contract due the User belong to a specific age group, the User is obliged to observe any such restrictions and not or use the Service or the Website, nor the App. As a person, an adult authorized to sign a binding contract, or an individual acting on behalf of a legal entity, the User declare that he/her are authorized to sign and bind their own person, whether natural or legal, to these Terms and Conditions in order to register to the Service, to to APP and to the Website.

Using the Website, the App or the Service, the User accept, furthermore:

(1) to use the Service, the Website and the App only for personal use and to not resale it to third parties;

(2) to not authorize third parties to use his/her account;

(3) to not assign or otherwise transfer his/her account to any other person or entity;

(4) to not use other accounts subject to the rights of third parties without proper authorization form them;

(5) to not use the Service, the Website or the App for unlawful purposes, including sending and archiving of any illegal material, or for fraudulent purposes;

(6) to not use the Service, the Website or the APP to cause annoyance or inconvenience;

(7) to not compromise the proper functioning of the network;

(8) to not make any damage, in any aspect, to the Service, the Website or the App;

(9) to not copy or distribute the Website, the App, or other content owned by Headquarters without the prior written consent of Headquarter;

(10) to keep confidential and secure the account password or any other identification credential provided to make access to the Service, the Website or the App;

(11) to provide any proof of identity at Headquarters that could be reasonably required;

(12) to be aware that all forms of communication will be subject to the normal fees charged by the operator that manages the used channel;

(13) to not use the Service, the Website or the App on device not compatible or not authorized;

(14) to comply with all applicable laws in your country or in the country, state and/or city in which it is at the time of use of the Service, the Website or the App.

Headquarters reserves the right to terminate the opportunity to use the Website, the App or the Service if the User does not comply with fully provisions above.

1hmy

Users contracting partner of 1hmy network is defined in The Alma Developement LLC, having its offices at Hunkins Waterfront Plaza, Suite 556, Main Street, Charlestown, Island of Nevis, registered at the Nevis Chamber of Commerce under number L16474.

Copyright Policy

In respect, from the Users, of these Therms and Conditions, Headquarter guarantees to all the Users a limited, not-exclusive and not-transferable license to:

(a) view, download and print any content of 1hmy for only personal and not-commercial purposes

(b) view any accessible content for only personal and not-commercial purposes

The User can’t sub-provide to third parties the rights guaranteed in this section of the license.

All the images, graphics and text components used by 1hmy were made by 1hmy or regularly purchased in person or by third parts, by intermediation of specialized agencies, as a model with signed granted rights.

User may not use, copy, adapt, modify, create derivative works, distribute, license, sell, transfer, publicly display, publish, reproduce, transmit, stream and transmit, publish online or in the mass media, use for commercial purposes or authorize any other use of the Website, the App, the Service or the collective content, except as expressly provided in these Terms and Conditions.

The User can not reuse the collective content without the prior written consent of Headquarter. User doesn’t have implicit permissions or rights over the titles and rights expressly granted in these Terms and Conditions. Headquarters may, at its discretion, allow users to post, upload, publish, or transmit the contents of the Users on the Website or on the App.

The User contents shall not be considered confidential or of its unique property. The User acknowledge that Headquarter only acts as a passive actor for distribution of his/her contents and can not therefore be liable to him/her or third parties for the content or accuracy of the contents themselves. Headquarter is not required to a permanent monitoring of contents provided by Users, or to act as a mediator among the Users and, therefore, will act consequently.

Regardless of the foregoing, Users acknowledge and agree that any notes, opinions, comments, suggestions and other information expressed or included in their contents do not necessarily represent 1hmy.

Each User uses the content published by other users at their own risk. Each User represents and warrants that the content published or broadcast are original and do not constitute a copy of the work of third parties or that otherwise do not violate the intellectual property rights, privacy or personality ascribable to third parties and do not contain any defamatory or disparaging statements. In addition, each User represents and warrants that it has the legal capacity to make its approval as stipulated in this paragraph.

Each User shall indemnify Headquarter, its related companies and every affiliate, from expenses, damages, losses and expenses incurred or suffered as a result of his/her contents, from him/her published or broadcast or other use of the Website, or the App, or the Service than institutional purposes. Headquarters reserves the right, in its sole discretion, to block or remove (in whole or in part) the contents of a user, that he/she published or broadcasted, which Headquarter believes not in accordance with these Terms and Conditions (including materials that violate or may violate the rights of intellectual property, privacy or personality of a third party), or that are even unacceptable by 1hmy.

Intellectual Property Ownership

Headquarter alone (and its licensors, where applicable) shall own all right, title and interest, including all related intellectual property rights, in and to the Website, the App and the Services and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by a User or any other party relating to the Website, the App or the Services.

These Terms and Conditions do not constitute a sale and do not convey to the User any rights of ownership in or related to the Website, the App or the Services, or any intellectual property rights owned by Headquarter. 1hmy’s name, logo, payoff and the product names associated with the Website, the App and the Services are trademarks of Headquarter, its affiliated companies or third parties, and no right or license is granted to use them.

Termination of the contract

This agreement between Headquarter and each User shall (subject to this paragraph) subsist for an indefinite period.

The User are entitled to terminate this agreement at any time by permanent deletion of his
/her profile by the the Website an/or the App and deleting permanently the App from his/her smartphone, thus disabling the use of the Service.

Headquarter is entitled to terminate this agreement at any time and with immediate effect (by disabling the use of the Website, the App and the Services) if the User:

(a) violate or breach any term of these Terms and Conditions, or

(b) in the opinion of Headquarter, misuse the Website, the App or the Services.

Headquarter is not obliged to give you notice of such termination in advance.

Invalidity of one or more terms

The invalidity of any part of these Terms and Conditions shall not affect the validity of the other provisions of the text.

If and to the extent that any part of these Terms and Conditions is invalid, or is unacceptable in the given circumstances according to the criteria of reasonableness and fairness, a provision shall apply between the parties instead that is acceptable considering all the circumstances and which corresponds with the provisions of the invalid part as much as possible, taking into account the content and the purpose of these Terms and Conditions.

Modification of the service and user terms

1hmy reserves the right, at its sole discretion, to modify or replace any of these Terms and Conditions, or change, suspend, or discontinue the Services, the Website or the App (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the Website or by sending a notice through the Website, the App or via email. Headquarter may also impose limits on certain features and services or restrict the User access to parts or all of the Services without notice or liability.

Privacy policy

1hmy collects and processes the personal data of the visitors of the Website and Users of the Website and the App according to the Privacy Policy.

Language

The English text of these User Terms constitutes the official text. In the event of any discrepancy between the English text and a translation into another language, the English text shall prevail.

Privacy Policy for Clients

1hmy is committed to protecting the privacy of its Clients.

The following “Privacy Policy” identifies the information that The Alma Development LLC (hereinafter, for simplicity, “Headquarters” or “we”) can be treated and how we use this information to improve service for visitors and for the Clients during the use of the website www.1hmy.net (the “Website”) and the Application developed for mobile environment (the “APP”) and on-demand services (collectively the “Service”).

Children

Headquarter cares about the safety of children. Because the Service is not directed towards underage children, they are not allowed to register as Affiliate to the Service, or provide personal data. The application does not discriminate in relation to the lower or major age for all countries in which it provide the Service, but if we understand we have collected information belonging to under-ages, we will delete that information immediately. With this in mind, every report of unauthorized recording (sent to support@1hmy.net.) Will be well accepted for the purpose of continuous monitoring.

Technical and functional management of Website and App

When a User visit our Website, our website administrators process technical data such as your IP-address, visited webpages, the internet browser you use, your previous/next visited websites and the duration of a visit/session to enable us to deliver the functionalities of the Website. In addition, in certain instances the browser may prompt you for your geo-location to allow us to provide you with an enhanced experience. With this technical data our website administrators can manage the Website, for instance by resolving technical difficulties or improving the accessibility of certain parts of the Website. This way, we ensure that you can (continue to) find the information on the Website in a quick and simple manner.

For this purpose we also use cookies.

When you use our App, we also process technical data such as your IP-address, Device ID or MAC-address, and information about the manufacturer, model, and operating system of your mobile device. We use this data to enable us to deliver the functionalities of the App, resolve technical difficulties, provide you with the correct and most up to date version of the App and to improve the function of the App.

Client data

When a Client registers as a User, we collect all your provided personal data to ensure the commitment of all the Services and to have the necessary data to keep in touch with you in a customer care program.

We will use the information provided with the recording to create and manage customer accounts 1hmy. We reserve the right to disable an account if we suspect that you are using the Web Site or the APP to commit fraudulent or illegal acts, or if you violate the terms of use accepted at registration.

When a Client requests a service through the APP or the Website, we provide their contact details to our Affiliates to allow them to establish communication in case of problems with the appointment. At the same time we provide to the Client the information of the Affiliate that has taken in charge the booking.

An Affiliate who decides to upload a photo in his/her account, agree that this photo is visible to users of the site according to the rules of visibility permitted by the processes within. In this way a customer can see before the face and the work environment of an Affiliate and Affiliate may occur before the identity of a customer. Uploaded photos can be changed or cancelled at any time by logging into the personal profile.

When a Client pays a reservation, the data are provided to the User Payment Processor third party in order to make a financial transaction. Headquarters will use financial data only for the execution of payment processes.

Generating management information and statistical data

1hmy uses your personal data in an anonymized and aggregated form to closely monitor which features of the Service are used most, to analyze usage patterns and to determine where we should offer or focus our Service. We may share this information with third parties for industry analysis and statistics.

User rights

Every User have the right to information regarding his/her personal account data, including information about data he/she procided to us and information regarding each service requested either via the Website or the App. Every Client may at any time request correction or erasure of his/her personal data (with the deletion of the User account and the consequent impossibility to use the Service) by emailing us at support@1hmy.net.

Headquarter will respond to the request within 30 business days.

Every Client may also amend his/her personal data just by his/her account.

Retain

Unless specified otherwise in this Privacy Policy, Headquarter will retain Client information until he/she cancel his/her account, or until one year since the end of affiliation. If you wish to cancel your account or request that we no longer use your information to provide you services, please contact us at support@1hmy.net.

After deletion of the account we will anonymize data, unless these data are necessary to comply with a legal obligation or resolve disputes.

Security

1hmy has taken appropriate technical and organizational security measures against loss or unlawful processing of personal data. To this purpose, personal data are securely stored within our database, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers) as well as physical safeguards of the locations where data are stored.

However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won’t be intercepted while being transmitted to us over the Internet.

Any transmission of information by you to Headquarter is at your own risk. We recommend that you do not disclose your password to anyone.

Cookie Policy

The Website use the “cookies”. A Cookie is a little text file stored on the User environment with the purpose to memorize some information for the use of the Services: every Usar can modify the settings of his/her browser to accept or avoid the cookies.

Changes of this privacy policy

Headquarter may update this privacy statement to reflect changes to our information practices. If we make any material changes we will notify you by email and by means of a notice on the Website prior to the change becoming effective. We encourage the Users to periodically review this page for the latest information on our privacy practices.

Language

Service

1hmy is a booking service for providing either beauty or wellness treatments. The service, as previously told, is provided by The Alma Development LLC (Headquarter). An Affiliate can subscribe the agreement with Headquarter to enter in the 1hmy net to be found by the Client.
Every detail will be provided in the following paragraphs.

Affiliates

The 1hmy programs accepts the affiliation of either beauty and wellness salon or professionals in the field of beauty and wellness, or private citizens with title or certifications to provide beauty and wellness treatments. Each of these subjects can be an Affiliate filling the form available in the Website.

After the general information it is necessary to fill the survey to provide the information about affiliate profession and environment characteristics. These data will be used by an algorithm to classify the new Affiliate in one of the four “Dimensions”. Each “Dimension” has a unique pricelist that the Affiliate must accept to go ahead with the registration. The Affiliate must accept the applied commissions for the booking service.

After that, the Affiliate must accept the Terms and Conditions an has to proceed with the payment of the annual fee (with the creation of a profile and the pyment of the affiliation fee, an Affiliate implicitly accept the Term and Conditions of the Service).

There are two different types of profiles, each with a proper showcase containing the information of the Affiliate visible in the App: NORMAL profile contains the minimum information and PLUS profile contains a complete set of information including the contacts of the Affiliate. The choice of the type of profile implies a different price for the annual membership fee. To know the amounts, please refer to the pages on the Website.

After that, the Affiliate has to select the only treatments he/she wants to give through the 1hmy net. For each treatment it is required to declare the availability of the Client home providing for that treatment.

On registration, a unique 1hME code associated to the Affiliate is generated for the “word of mouth” program (1hWom).

Each Affiliate has a private dashboard on the Website to manage and update his/her information, his/her own appointment and his/her digital task agenda. To keep clear and updated the agenda is exclusive and specific responsibility of the Affiliate: every omissis, error, misunderstanding or disruption due to poor or incorrect use of his/her own agenda will be in charge of the Affiliate. In particular, a Client will fix an appointment coherently with the Affiliate agenda. In case of unavailability of the Affiliate despite of what written in the agenda, the Affiliate will have to solve the problem born with the Client.

The digital agenda permits to set up and handle every kind of unavailability, e.g. holidays, closures or other external commitments.

IMPORTANT: to activate the 1hmy platform, each Affiliate must have a valide and verified Paypal account.

An Affiliate can also shop either treatments or gifts as every Client by the 1hmy platform. In those cases are applied the Terms and Conditiond of Use published for yhe Clients.

1hmy Commissions

The treatments provided by the Affiliates have fixed prices as written in the pricelists of the four 1hmy “Dimensions”. For providing at home, a surcharge (different for each dimension) is applied.

Affiliates must keep in count the following Service costs:

(a) An yearly affliation fee to pay one time in the year in a single transaction. See the prices, the profile typology (either NORMAL or PLUS) on the pertaining pricelist of your Country, on the 1hmy Website.

(b) A commission in terms of percentage of the official price, for each treatment sold by the 1hmy booking system.

The percentage of commission is applied also on the surcharge provision of home service.

An Affiliate can request an upgrade from profile NORMAL to profile PLUS at any time of the year. It is never possible to downgrade the profile from PLUS to NORMAL.

If 1hmy decides to introduce a new program of commissions, Headquarter will inform the Affiliates to allow everyone to decide whether to continue or terminate the affiliation to the Service. The percentages of commissions for each individual treatment sold, can be found on the official 1hmy pricelists. The annual membership fee is not refundable in any case, even partially.

All 1hmy fees, are to be attributed to the costs for managing and updating the platform, to the efforts of global marketing and to the profit of the platform itself. Headquarters reserves the right to change the annual affiliation commissions and the percentages fees at any time and without notice.

Pricelists

The Client pays the purchased treatments with the prices written in a unique pricelist, equal for every Affiliates with the same “Dimension”. The official prices, are available in the Affiliate Dashboard, part of the Website, after the access with Affiliate credentials. Prices can be modified by Headquarter in every moment without any forewarning.

It is an Affiliate responsibility to see the conditions applied at the moment of the Client booking (by the App or the Website). In case of change of price, a treatment will have the price payed at the booking time.

Payment of treatments

The Client pays in advance to 1hmy the price of the treatment booked by the system.

The Client agrees to pay the cost of the services and authorizes Headquarter to debit on his/her account the relative amount.

The Client is held responsible for the timely payment of all the costs involved, and shall provide to Headquarters a number of credit card or a valid PayPal account.

The Affiliate is responsible to issue to the Client a receipt for the total amount, as in the 1hmy pricelist, including tax if due.

Headquarters will pay the Affiliate with the amount pertaining for the provided treatment minus the cost of 1hmy services.

Headquarter releases to the Affiliate a receipt for the cost of the Service.

In the Client personal profile there is an electrnic wallet called 1hPIGGY in which itis possible to deposit temporarily some credit from Client’s PayPal account. The credit can be used only to purchase services or products in the 1hmy system and it is not refundable. The credit can be used only in the Client’s country, that is where it is used the currency of the 1hPIGGY deposit.
Therefore, a customer can pay via PayPal (using its PayPal credit or a credit card accepted by PayPal) or by the credit in his 1hPYGGY.
1hmy do not reimburse payments except in cases where has been proved a booking service interruption. Inconvenience to the service delivery of the treatments are considered in charge only to the Affiliate that caused them.

1hmy uses a system of processing payments provided by a third part (“Payment Processor”) that connects the customer’s credit card by the App and the Web Site. The processing of payments or credits, where applicable, will be subject to the terms, conditions and privacy policy of Payment Processor, and of the company that provide the credit cards, in addition to these Terms and Conditions. Headquarters will not be liable for any error attributable to the Payment Processor.

In reference to the use of the Services by the Clients, Headquarters will have access to some details of the transactions that will be used only in accordance with the Privacy Policy.

Vouchers

The voucher code purchased by the customer for a reservation or for a gift certificate is a title for the amount of the treatment. The voucher, unless otherwise indicated, will expire after 365 days from the date of issue.
The voucher issued by 1hmy can only be used in the country where they were purchased.
Presenting the voucher to the Affiliate, the Client decale “de facto” to have benefited the treatment. When the Affiliate insert the Reservation Code of the Voucher in the system 1hmy, he/she declare, “de facto”, that it has done its job.

Since fulfillment of the Reservation Code, any further discussion about the voucher or the reservation time must be resolved between the Client and the Affiliate except it is shown an irregularity in the 1hmy booking service.

After the expiration date, the Voucher value is not returned. The Voucher 1hmy is not refundable under any circumstances.

Gift Vouchers

When booking, the Client may decide to transform the treatment in a Gift Voucher, that is a code that represents a title of the amount spent by the Client. The beneficiary receives an email with the Gift Voucher and he/her can use it directly by one of the Affiliates without having to create their own profile in the system.

The Gift Voucher, unless otherwise indicated, will expire after 365 days from the date of issue. After the expiration date, the Gift Voucher value is not returned. The Gift Voucher 1hmy is not refundable under any circumstances.

1hWOM Program

Each Affiliate has a chance to get a gift for each new Client and for each new Affiliate that enters the 1hmy network following his/her suggestion. The program is called One Hour Word of Mouth (abbreviated in the acronym 1hWOM). Listed below are the rules to get the gift:

(1) The new User should not have been registered in the 1hmy systems.

(2) The new User must enter in the appropriate field of the registration form the 1hME code of the User who suggested the registration. It’t no possible to get any benefit if the 1hME code were communicated at different times from registration.

The Discount or Bonus Voucher, are awarded in the form of a free gift as a thanks for the User cooperation. The value of the discount or bonus voucher, are defined by the 1hWOM program valid at the time of the new User registration.

1hmy may change at any time awards or conditions, without notice. It is the responsibility of each User to refer to this section and to the information available on the official Website to stay updated on the 1hWOM program.

Different conditions of collaborations can be managed directly with Headquarters outside the Terms and Conditions.

The Discount or Bonus Voucher, unless otherwise indicated, expires after 365 days from the date of issue. The 1hmy Discount or Bonus Voucher is not refundable under any circumstances.

Limitation of liability

The information, recommendations and/or services provided to the User by or through the Website and the App are intended for information purposes only without any commercial intent, with the exclusion of the banner in some pages of the App. Headquarter will use their resources to keep up to date and correct the Website, the App and its contents but does not guarantee that (the contents of) these are free of errors, defects, viruses or malware and that the Website and the APP are accurate, current and precise.

Headquarters will not be considered liable for any damage arising from the use (or inability to use) of the Website or of the App, including damage caused by malware, viruses or other inaccuracy/incomplete information, of the Website or of the APP, unless such damage is clearly derived from willful misconduct or gross negligence in charge at headquarters.

Moreover, Headquarters will not be held responsible for damages arising from the use (or inability to use) of the electronic media in conjunction with the Website or with the APP, which – including – damage resulting from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications made by third parties or by programs used for electronic communications and transmission of viruses.

Notwithstanding the foregoing, and as permitted by applicable law, the entire liability of Headquarter will not exceed, in any way, the amount of USD 500 (five hundred), or where applicable, the equivalent to that amount in the currency used by the User for payment of beauty or wellness services provided by 1hmy network Affiliates.

The quality of health and beauty treatments enjoyed using the services of 1hmy is intended entirely in charge of the Affiliates as providers of end-user services. In any case Headquarter will take responsibility related to and/or arising from services provided and/or produced by the Affiliates or any acts, actions, behavior, conduct and/or serious misconduct attributable to Affiliates. Any complaints relating to services provided by Affiliates will then be notified directly and exclusively to Affiliates themselves.

Regarding the content, 1hmy is a showcase of information and opinions provided by Clients and Affiliates. Headquarters can’t be held in any way responsible for such content. 1hmy is a network created only for the services of health and beauty. Any other use, especially those related to sexual content or services, will not be tolerated. 1hmy is a worldwide network and it’s not designed for the use in a single simultaneous nation: each contextualization of procedures in compliance with local laws is the responsibility of each User who has to apply a personal moderation in the system use.

Headquarter provide the following services:

(a) Build and maintenance of the technical architecture for the Website and for the App.

(b) Marketing actions at national level.

(c) Booking service made by the Website and the App.

(d) Renting of the advertising spaces on the App.

Applicable law

These terms of use are subject to the laws of the Island of Nevis. Any dispute, claim or litigation arising from or related to these Terms and Conditions, or the breach, termination, enforcement, interpretation or validity of them, or the use of the Website, the Service or the App (collectively, “Disputes”) shall be addressed exclusively to the court of jurisdiction of the island of Nevis. Headquarters will only respond to the services provided by 1hmy.

Any dispute relating to the services provided and/or products sold by Affiliates, will be addressed directly and exclusively to Affiliates themselves. The service 1hmy is provided only in the countries published on the Website.

1hmy Account

You must be “major” (“adult” compared to the country of use) in order to use the Service or the App 1hmy. If you reside in a jurisdiction which restricts the use of the Service, the Website or the App or the ability to sign this kind of contract due the User belong to a specific age group, the User is obliged to observe any such restrictions and not or use the Service or the Website, nor the App. As a person, an adult authorized to sign a binding contract, or an individual acting on behalf of a legal entity, the User declare that he/her are authorized to sign and bind their own person, whether natural or legal, to these Terms and Conditions in order to register to the Service, to to APP and to the Website.

Using the Website, the App or the Service, the User accept, furthermore:

(1) to use the Service, the Website and the App only for personal use and to not resale it to third parties;

(2) to not authorize third parties to use his/her account;

(3) to not assign or otherwise transfer his/her account to any other person or entity;

(4) to not use other accounts subject to the rights of third parties without proper authorization form them;

(5) to not use the Service, the Website or the App for unlawful purposes, including sending and archiving of any illegal material, or for fraudulent purposes;

(6) to not use the Service, the Website or the APP to cause annoyance or inconvenience;

(7) to not compromise the proper functioning of the network;

(8) to not make any damage, in any aspect, to the Service, the Website or the App;

(9) to not copy or distribute the Website, the App, or other content owned by Headquarters without the prior written consent of Headquarter;

(10) to keep confidential and secure the account password or any other identification credential provided to make access to the Service, the Website or the App;

(11) to provide any proof of identity at Headquarters that could be reasonably required;

(12) to be aware that all forms of communication will be subject to the normal fees charged by the operator that manages the used channel;

(13) to not use the Service, the Website or the App on device not compatible or not authorized;

(14) to comply with all applicable laws in your country or in the country, state and/or city in which it is at the time of use of the Service, the Website or the App.

Headquarters reserves the right to terminate the opportunity to use the Website, the App or the Service if the User does not comply with fully provisions above.

Users contracting partner of 1hmy network is defined in The Alma Developement LLC, having its offices at Hunkins Waterfront Plaza, Suite 556, Main Street, Charlestown, Island of Nevis, registered at the Nevis Chamber of Commerce under number L16474.

Copyright Policy

In respect, from the Users, of these Therms and Conditions, Headquarter guarantees to all the Users a limited, not-exclusive and not-transferable license to:

(a) view, download and print any content of 1hmy for only personal and not-commercial purposes

(b) view any accessible content for only personal and not-commercial purposes

The User can’t sub-provide to third parties the rights guaranteed in this section of the license.

All the images, graphics and text components used by 1hmy were made by 1hmy or regularly purchased in person or by third parts, by intermediation of specialized agencies, as a model with signed granted rights.

User may not use, copy, adapt, modify, create derivative works, distribute, license, sell, transfer, publicly display, publish, reproduce, transmit, stream and transmit, publish online or in the mass media, use for commercial purposes or authorize any other use of the Website, the App, the Service or the collective content, except as expressly provided in these Terms and Conditions.

The User can not reuse the collective content without the prior written consent of Headquarter. User doesn’t have implicit permissions or rights over the titles and rights expressly granted in these Terms and Conditions. Headquarters may, at its discretion, allow users to post, upload, publish, or transmit the contents of the Users on the Website or on the App.

The User contents shall not be considered confidential or of its unique property. The User acknowledge that Headquarter only acts as a passive actor for distribution of his/her contents and can not therefore be liable to him/her or third parties for the content or accuracy of the contents themselves. Headquarter is not required to a permanent monitoring of contents provided by Users, or to act as a mediator among the Users and, therefore, will act consequently.

Regardless of the foregoing, Users acknowledge and agree that any notes, opinions, comments, suggestions and other information expressed or included in their contents do not necessarily represent 1hmy.

Each User uses the content published by other users at their own risk. Each User represents and warrants that the content published or broadcast are original and do not constitute a copy of the work of third parties or that otherwise do not violate the intellectual property rights, privacy or personality ascribable to third parties and do not contain any defamatory or disparaging statements. In addition, each User represents and warrants that it has the legal capacity to make its approval as stipulated in this paragraph.

Each User shall indemnify Headquarter, its related companies and every affiliate, from expenses, damages, losses and expenses incurred or suffered as a result of his/her contents, from him/her published or broadcast or other use of the Website, or the App, or the Service than institutional purposes. Headquarters reserves the right, in its sole discretion, to block or remove (in whole or in part) the contents of a user, that he/she published or broadcasted, which Headquarter believes not in accordance with these Terms and Conditions (including materials that violate or may violate the rights of intellectual property, privacy or personality of a third party), or that are even unacceptable by 1hmy.

Intellectual Property Ownership

Headquarter alone (and its licensors, where applicable) shall own all right, title and interest, including all related intellectual property rights, in and to the Website, the App and the Services and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by a User or any other party relating to the Website, the App or the Services.

These Terms and Conditions do not constitute a sale and do not convey to the User any rights of ownership in or related to the Website, the App or the Services, or any intellectual property rights owned by Headquarter. 1hmy’s name, logo, payoff and the product names associated with the Website, the App and the Services are trademarks of Headquarter, its affiliated companies or third parties, and no right or license is granted to use them.

Termination of the contract

This agreement between Headquarter and each User shall (subject to this paragraph) subsist for an indefinite period.

The User are entitled to terminate this agreement at any time by permanent deletion of his
/her profile by the the Website an/or the App and deleting permanently the App from his/her smartphone, thus disabling the use of the Service.

Headquarter is entitled to terminate this agreement at any time and with immediate effect (by disabling the use of the Website, the App and the Services) if the User:

(a) violate or breach any term of these Terms and Conditions, or

(b) in the opinion of Headquarter, misuse the Website, the App or the Services.

Headquarter is not obliged to give you notice of such termination in advance.

Invalidity of one or more terms

The invalidity of any part of these Terms and Conditions shall not affect the validity of the other provisions of the text.

If and to the extent that any part of these Terms and Conditions is invalid, or is unacceptable in the given circumstances according to the criteria of reasonableness and fairness, a provision shall apply between the parties instead that is acceptable considering all the circumstances and which corresponds with the provisions of the invalid part as much as possible, taking into account the content and the purpose of these Terms and Conditions.

Modification of the service and user terms

1hmy reserves the right, at its sole discretion, to modify or replace any of these Terms and Conditions, or change, suspend, or discontinue the Services, the Website or the App (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the Website or by sending a notice through the Website, the App or via email. Headquarter may also impose limits on certain features and services or restrict the User access to parts or all of the Services without notice or liability.

Privacy policy

1hmy collects and processes the personal data of the visitors of the Website and Users of the Website and the App according to the Privacy Policy.

Language

The English text of these User Terms constitutes the official text. In the event of any discrepancy between the English text and a translation into another language, the English text shall prevail.

Privacy Policy for Affiliates

1hmy is committed to protecting the privacy of its Affiliates.

The following “Privacy Policy” identifies the information that The Alma Development LLC (hereinafter, for simplicity, “Headquarters” or “we”) can be treated and how we use this information to improve service for visitors and for the Affiliates during the use of the website www.1hmy.net (the “Website”) and the Application developed for mobile environment (the “APP”) and on-demand services (collectively the “Service”).

Definitions

1hmy” – Name of the digital booking system for the beauty and wellness treatments.

1hME” – Unique code associate to each User.

Affiliate” – Either Salon, Professional or Private Citizen who has stipulated an agreement with Headquarter about the bookong of beauty or wellness treatments.

APP” – software application for mobile environment and related services provided by Headquarter.

Client” – Registered User who can book treatment by 1hmy service.

Dimensions” – name of the cathegories in which the affiliates are divided.

Headquarter” – synonym of The Alma Development LLC.

Servizio” – it means the entire 1hmy service, mainly the service of booking for beauty or wellness treatments by the Website and the App.

Website” – set of web pages reachable by the address www.1hmy.net and other related addresses.

User” – Every individual who create a personal profile in the 1hmy environment through the App or the Website. A User can be a Client or an Affiliate or both.

Children

Headquarter cares about the safety of children. Because the Service is not directed towards underage children, they are not allowed to register as Affiliate to the Service, or provide personal data. The application does not discriminate in relation to the lower or major age for all countries in which it provide the Service, but if we understand we have collected information belonging to under-ages, we will delete that information immediately. With this in mind, every report of unauthorized recording (sent to support@1hmy.net.) Will be well accepted for the purpose of continuous monitoring.

Technical and functional management of Website and App

When a User visit our Website, our website administrators process technical data such as your IP-address, visited webpages, the internet browser you use, your previous/next visited websites and the duration of a visit/session to enable us to deliver the functionalities of the Website. In addition, in certain instances the browser may prompt you for your geo-location to allow us to provide you with an enhanced experience. With this technical data our website administrators can manage the Website, for instance by resolving technical difficulties or improving the accessibility of certain parts of the Website. This way, we ensure that you can (continue to) find the information on the Website in a quick and simple manner.

For this purpose we also use cookies.

When you use our App, we also process technical data such as your IP-address, Device ID or MAC-address, and information about the manufacturer, model, and operating system of your mobile device. We use this data to enable us to deliver the functionalities of the App, resolve technical difficulties, provide you with the correct and most up to date version of the App and to improve the function of the App.

Affiliate data

When a Client requests a service through the APP or the Website, we provide their contact details to our Affiliates to allow them to establish communication in case of problems with the appointment. At the same time we provide to the Client the information of the Affiliate that has taken in charge the booking.

An Affiliate who decides to upload a photo in his/her account, agree that this photo is visible to users of the site according to the rules of visibility permitted by the processes within. In this way a customer can see before the face and the work environment of an Affiliate and Affiliate may occur before the identity of a customer. Uploaded photos can be changed or cancelled at any time by logging into the personal profile.

When an Affiliate pays or receives a payment, the data are provided to the User Payment Processor third party in order to make a financial transaction. Headquarters will use financial data only for the execution of payment processes.

Generating management information and statistical data

1hmy uses your personal data in an anonymized and aggregated form to closely monitor which features of the Service are used most, to analyze usage patterns and to determine where we should offer or focus our Service. We may share this information with third parties for industry analysis and statistics.

User rights

Every User have the right to information regarding his/her personal account data, including information about data he/she procided to us and information regarding each service requested either via the Website or the App. Every Affiliate may at any time request correction or erasure of his/her personal data (with the deletion of the User account and the consequent impossibility to use the Service) by emailing us at support@1hmy.net.

Headquarter will respond to the request within 30 business days.

Every affiliate may also amend his/her personal data just by his/her account.

Retain

Unless specified otherwise in this Privacy Policy, Headquarter will retain Affiliate information until he/she cancel his/her account, or until one year since the end of affiliation. If you wish to cancel your account or request that we no longer use your information to provide you services, please contact us at support@1hmy.net.

After deletion of the account we will anonymize data, unless these data are necessary to comply with a legal obligation or resolve disputes.

Security

1hmy has taken appropriate technical and organizational security measures against loss or unlawful processing of personal data. To this purpose, personal data are securely stored within our database, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers) as well as physical safeguards of the locations where data are stored.

However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won’t be intercepted while being transmitted to us over the Internet.

Any transmission of information by you to Headquarter is at your own risk. We recommend that you do not disclose your password to anyone.

Cookie Policy

The Website use the “cookies”. A Cookie is a little text file stored on the User environment with the purpose to memorize some information for the use of the Services: every Usar can modify the settings of his/her browser to accept or avoid the cookies.
